TERMS AND CONDITIONS OF THE ONTINYENT PUBLIC BIKE-SHARING SERVICE

1. Purpose of the Service This document sets out the terms and conditions governing access to and use of the Ontinyent public bike-sharing service (hereinafter, the "Service"). The aim of the Service is to provide citizens with a regular, sustainable, and efficient mobility system through shared bicycles.

2. Description of the Service The Service consists of:

  • Pedal-assisted electric bicycles
  • Charging stations with docking points (electric docks)
  • Parking areas without charging (bike racks)
  • Mobile app or digital access system

Types of stations:

  • 8 charging stations, each with 10 electric docking points (capacity for 10 bicycles)
  • 19 parking areas without charging:
    • 18 stations with capacity for 6 bicycles
    • 1 station with capacity for 10 bicycles

Bicycles may be picked up or returned at any of these designated locations.

3. Area of Use Use of the Service is limited to the municipal area of Ontinyent.

4. Access Conditions The Service may be used by:

  • Persons aged 16 and over
  • Minors with legal authorisation

The user declares that they:

  • Are in adequate physical condition
  • Will comply with traffic regulations
  • Accept these general conditions

Access is personal and non-transferable.

5. Subscription Types and Rates Access to the Service is provided through a subscription:

5.1 General Subscription

  • Price: €15
  • Duration: 12 months
  • Includes: First 30 minutes free per trip
  • Additional use: €0.50 per additional 30-minute period

5.2 Single Subscription

  • Price: €5
  • Duration: 30 days
  • Use: €0.50 per 30-minute period from the start of the trip

5.3 General Conditions of Use

  • Time is calculated from the moment of unlocking until the bicycle is correctly locked
  • Each new unlock starts a new trip
  • Prices may be updated and will be communicated in advance

6. Registration, Renewal and Cancellation

Registration Carried out through the app or authorised channels.

Renewal

  • May be automatic
  • The user will be notified in advance

Cancellation The user may cancel their subscription at any time. Amounts already paid will not be refunded.

7. Use of the Service

7.1 Starting a Trip The user must:

  • Log in to the system
  • Unlock the bicycle
  • Check its condition

If a problem is detected, the user must return it within a maximum of 2 minutes.

7.2 During Use The user is responsible for the bicycle throughout the trip.

7.3 End of Trip The trip ends when:

  • The bicycle has been correctly:
    • Docked at a charging station, or
    • Parked in a designated area without charging (bike rack)
  • And the system confirms the trip has ended

If not correctly ended, the trip will remain active.

8. Parking Bicycles may be parked:

At charging stations:

  • By slotting the bicycle in and ensuring the rear wheel lock is activated
  • This allows the battery to recharge

In areas without charging (bike racks):

  • Must be parked correctly in the designated racks
  • The user must ensure the bicycle is secured by wrapping the chain around the bike rack and activating the rear wheel lock

Parking outside these areas is prohibited. If a user attempts to end a trip outside permitted parking zones, the system will record it as a pause and time will continue counting as part of the trip.

9. Usage Limits To ensure the efficiency of the system:

  • Each trip is intended for short-term use (≤30 min)
  • Extended use incurs additional charges
  • The operator may set maximum usage limits per trip

10. User Obligations The user undertakes to:

  • Use the bicycle with care
  • Not transfer it to third parties
  • Check its condition before use
  • Report any incident
  • Take care of it during the trip

11. Prohibited Actions The following actions are prohibited:

  • Lending the bicycle
  • Commercial use
  • Carrying passengers
  • Tampering with bicycles or stations
  • Using it under the influence of alcohol or drugs
  • Leaving the bicycle outside designated areas

12. Liability The user will be liable for:

  • Damage to the bicycle
  • Damage to third parties
  • Misuse

The operator may claim the corresponding costs.

13. Theft or Loss In the event of theft or loss:

  • Immediate notification is required
  • A police report must be filed within 24 hours

Failing to do so, the user will bear the full cost.

14. Violations and Sanctions A violation may result in:

  • Temporary suspension
  • Financial penalties
  • Termination of service

Classified by severity: minor, serious, or very serious.

15. Customer Service Available channels:

16. Data Protection Processing in accordance with the GDPR and applicable regulations.

17. Amendments The operator may amend these terms and conditions with prior notice.

18. Applicable Law Governed by Spanish legislation.
